Terms and Conditions

These Terms and Conditions apply when you buy merchandise, physical music releases, or other products from the official Apotheus online store at apotheus.net/merch. They explain who is selling the products, how orders are handled, and the rights and responsibilities that apply to you and to us.
By placing an order, you confirm that you have read and accepted these terms. If you are acting as a consumer, nothing in these terms limits any rights that cannot lawfully be excluded under applicable consumer law.
Store operator
The seller and contracting party is Albano Valério Gomes Rosário, trading as Apotheus, with its registered or business address at Rua de Ferreiró do Fundo, 76, 4590-789, Ferreira, Portugal and Portuguese tax or VAT number 238977110.

Scope of these terms
These terms apply to purchases made through the official Apotheus online store. We deliver only to destinations offered during checkout.
You must be at least 18 years old, or have the permission of a parent or legal guardian, and have legal capacity to enter into a contract. You are responsible for making sure that the information you provide during checkout is complete and accurate. Orders are currently placed as a guest, and no customer account is required.
Products and availability
We take reasonable care to describe and photograph products accurately. Screen settings, lighting, manufacturing processes, and the handmade or printed nature of some items may cause minor differences in colour or appearance. These minor differences do not affect your statutory rights where a product is defective or materially different from its description.
Please review the product description, measurements, size information, materials, format, and any care or safety instructions before ordering. Images are illustrative, and accessories shown in photographs are not included unless the product description says otherwise.
Products are offered subject to availability. Adding an item to your cart does not reserve it. If stock information is incorrect or an item becomes unavailable after you order, we will contact you and offer an appropriate solution, which may include a refund for the unavailable item.
Prices and taxes
Prices are displayed in euros unless stated otherwise. The total amount payable, including applicable taxes and delivery charges, is shown during checkout before you place the order.
Delivery charges depend on the destination, products, quantities, and shipping method. The available options and current cost are calculated from the delivery address entered at checkout.
If a price or other product information contains an obvious error, we may contact you before accepting the order to confirm whether you wish to proceed with the corrected information. We will not charge a corrected price without your agreement.
Orders and contract formation
To order, select the product and any required variation, add it to your cart, review the cart, and complete checkout. Before submitting the order, you can review and correct your products, quantities, delivery details, shipping method, and payment information.
Submitting an order is an offer to buy the products in your cart. The automatic order acknowledgement confirms that we received your order, but does not by itself mean that the order has been accepted. A contract is formed when we expressly accept the order, confirm dispatch, or otherwise begin fulfilling it.
We may decline or cancel an order before acceptance where reasonably necessary, including because a product is unavailable, payment cannot be authorised, delivery is not available to the supplied address, fraud or misuse is suspected, a legal restriction applies, or the displayed price or description contains an obvious error. If we cancel after receiving payment, we will refund the affected amount.
Payment
The available payment methods are shown at checkout and may vary by country or device. Payments are handled securely by the payment provider shown during checkout. We do not receive or store your full card number.
Your payment method may be authorised or charged when the order is submitted, including for pre-orders. An order is not confirmed merely because a payment attempt has been authorised. If payment fails, expires, is reversed, or requires additional action, the order may remain unpaid or be cancelled.
You confirm that you are authorised to use the selected payment method and that the billing information you provide is accurate.
Shipping and delivery
We deliver only to destinations and by the methods offered during checkout. Delivery times are estimates rather than guaranteed dates unless we expressly agree otherwise. Unless a different delivery period is agreed, including for a clearly identified pre-order, we aim to deliver without undue delay and no later than 30 days after the contract is formed.
You are responsible for supplying a complete and accurate delivery address and for responding to reasonable delivery or customs requests. If an order is returned because the address was incorrect, delivery was refused, or it was not collected, we may charge the reasonable cost of sending it again, where permitted by law.
For deliveries outside the European Union, the destination country may charge import VAT, customs duties, handling fees, or similar charges. Unless checkout expressly says that these charges are included, they are the customer’s responsibility and are not collected or controlled by us.
Risk of loss or damage passes to a consumer when the consumer, or a person nominated by them other than the carrier, physically receives the products. Please inspect the parcel after delivery and contact us promptly at info@apotheus.net if anything is missing, damaged, or incorrect.
Pre-orders
A product marked “Pre-order” is not ready for immediate dispatch. Its expected release or shipping date is shown on the product page and may also appear during checkout or in the order information.
Release and production dates are estimates and can change for reasons outside our reasonable control. If a material delay occurs, we will contact you using the email address supplied with the order. You may cancel the delayed pre-order item and receive a refund for that item unless it has already been dispatched.
If an order contains both available products and pre-order products, we may dispatch them together when the pre-order becomes available or separately. Where separate dispatch creates an additional charge, that charge will be disclosed before you place the order or agreed with you afterwards.
Cancellations, returns and refunds
Consumer right of withdrawal
If you are a consumer in the European Union or another jurisdiction that provides an equivalent right, you may normally withdraw from an online purchase without giving a reason within 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods. For an order delivered in separate parcels, the period normally starts when the final parcel is received.
To exercise this right, email info@apotheus.net before the deadline with a clear statement that you wish to withdraw. Include your name, order number, the products concerned, the date ordered and received, and your contact details. You may use the model withdrawal form below, but it is not compulsory.
After notifying us, you must return the products without undue delay and no later than 14 days after your notice. We will provide the appropriate return address and instructions. Do not send returns without first contacting us.
Unless we agree otherwise, you are responsible for the direct cost of returning products under the withdrawal right. We recommend using a tracked service and keeping proof of postage.
You may inspect products only as you would reasonably be allowed to do in a physical shop. You may be responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the products.
Where the withdrawal right applies, we will reimburse payments received for the returned products and the cost of the least expensive standard delivery method offered for the original order. We do not have to refund any extra cost resulting from your choice of a more expensive delivery method. We will issue the reimbursement using the original payment method, without undue delay and within 14 days after receiving your withdrawal notice. For goods, we may withhold reimbursement until we receive the goods or you provide evidence that they were sent back, whichever happens first.
Exceptions to the withdrawal right
The statutory withdrawal right may not apply to:
- products made to your specifications or clearly personalised;
- sealed audio or video recordings, or sealed computer software, after the seal has been broken;
- sealed goods that are not suitable for return for health protection or hygiene reasons, after the seal has been broken; and
- other products or circumstances excluded by applicable mandatory law.
Choosing a standard size, colour, or other standard product variation does not by itself make a product personalised.
Defective, damaged, or incorrect products
The withdrawal right is separate from your rights when a product is defective, damaged, incorrect, or does not match its description. New movable goods are covered by the legal guarantee of conformity required by applicable consumer law. Under current Portuguese law, the seller is responsible for a lack of conformity that becomes apparent within three years of delivery, without prejudice to any stronger mandatory protection that applies to you.
If you believe a product is not in conformity, contact info@apotheus.net with your order number, a description of the issue, and photographs where useful. Depending on the circumstances and your statutory rights, the available remedy may include repair, replacement, a price reduction, or termination of the contract and a refund.
We bear the reasonable return or collection costs for products confirmed to be defective, damaged, incorrect, or otherwise non-conforming. These terms do not replace or reduce any mandatory legal guarantee.
Refunds
Approved refunds are sent to the original payment method unless another method is expressly agreed. Banks and payment providers may take additional time to display the refund after we process it.

Intellectual property
The Apotheus name, logos, music, lyrics, artwork, photographs, videos, product designs, text, and other website content are owned by Apotheus or used with permission. They are protected by intellectual property laws.
You may access the website and use purchased products for personal, non-commercial purposes. You may not reproduce, distribute, modify, sell, exploit, or use website content or protected material commercially without prior written permission from the relevant rights holder.
Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
Subject to the previous paragraph, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, losses caused by inaccurate information supplied by you, or business losses arising from a consumer purchase.
We are not responsible for delays or failures caused by events beyond our reasonable control. If such an event materially affects an order, we will take reasonable steps to minimise the impact and will contact you where appropriate. Your mandatory cancellation and refund rights remain unaffected.
Privacy
We process personal data to operate the store, fulfil orders, take payment, arrange delivery, prevent fraud, provide support, and comply with legal obligations. Please read our Privacy Policy for more information.
Changes to these terms
We may update these terms from time to time. The version that applies to an order is the version made available when you place it, unless a change is required by law or is more favourable to you. Changes do not remove or reduce rights relating to an order that has already been accepted.
Governing law and disputes
These terms and contracts made through the store are governed by Portuguese law. If you are a consumer resident in another country, this choice does not deprive you of mandatory consumer protections provided by the law of your country of residence. Any dispute may be brought before the courts that have jurisdiction under applicable mandatory law.
Complaints and alternative dispute resolution

Consumers in Portugal may also submit a complaint through the official Electronic Complaints Book.
